(the "Company") was deemed to make an assignment in bankruptcy on the 9th day of March, 2016 and Alvarez and Marsal Canada Inc. was appointed as the Trustee in bankruptcy (the "Trustee") of the Company by the Office Receiver, subject to affirmation by the creditors of the Trustee's appointment at the First Meeting of Creditors.
